Bellhop, Inc. (referred to herein as “Bellhop,” “us,” “our,” or “we”) values its relationship with you and takes your privacy seriously. This Privacy Policy (this “Policy”) describes the types of information we may collect from you or that you may provide when you visit any of our websites, including without limitation www.getbellhops.com and www.bellhop.com (each, a “Website”), or access and use our mobile applications (each, an “App,” and together with the Websites, the “Bellhop Platforms”) in order to purchase moving or delivery services provided by third party providers, receive an estimate or information about such services, view our blog, or otherwise use our services (collectively, the “Services”), and our practices for collecting, using, maintaining, protecting and disclosing such information.

This Policy applies to information we collect through the Bellhop Platforms, and applies to users of the Bellhop Platforms, including Movers and Mover applicants (collectively “Movers”). It does not apply to information collected on any other website operated by any third party, including through any application or content (including advertising) that may link to or be accessible through the Bellhop Platforms.

INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We collect several types of information from and about users of the Bellhop Platforms, including:

  • Personally Identifiable Information: Information by which you may be personally identified or contacted, whether directly or indirectly, such as name, postal address, e-mail address, telephone number, credit card information, and biographical information (“Personal Information”).
  • Anonymous Information: Information that is in a form that does not permit direct association with a specific individual and is aggregate data that website and applications use to administer their sites, services, and content. Anonymous information may include such information as your browser or device type, your IP address, log file information, cookie and web beacon information, and information from similar tracking technologies.

We collect this information in a range of ways, as further described below:

  • Directly from you when you provide it to us through the Bellhop Platforms.
  • Automatically as you navigate through the Bellhop Platforms. Information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons, and other tracking technologies.
  • From third parties, for example, our business partners or third party providers.
  1. Information You Provide to Us.

The information we collect on or through the Bellhop Platforms may include:

  • Information that you provide by filling in forms through the Bellhop Platforms. This includes information provided at the time of purchasing Services, subscribing to our blog, posting material, submitting feedback or a review, or requesting further Services or an estimate for Services.
  • If you apply to be a Bellhop Mover, information that you provide by filling in forms through the Bellhop Platforms. This includes name, email address, phone number, transportation, task and background check assertions, and schedule availability.
  • When you report a problem with the Bellhop Platform or report an issue with our claim center. This information includes your email address and any other information you choose to provide Bellhop.
  • We also may ask you for information when you elect to participate in an educational scholarship application process, contest, or promotion sponsored by us. This information includes name, address, phone number, email address, and may, in some instances, include educational and biographical information.
  • Records and copies of your correspondence (including e-mail addresses), if you contact us.
  • Details of transactions you carry out through the Bellhop Platforms and of the fulfillment of your Service orders. You may be required to provide financial information before placing an order through the Bellhop Platforms.
  • Your search queries through the Bellhop Platforms.

You also may provide information to be published or displayed (hereinafter, posted) on public areas of the Bellhop Platform, or transmitted to other users of the Bellhop Platforms or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Bellhop Platforms with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

  1. Information We Collect Through Automatic Data Collection Technologies.

When you visit or interact with the Bellhop Platforms, we may use automatic data collection technologies to collect certain information about your browsing actions and patterns, including:

  • Details of your visits to the Bellhop Platforms, including traffic data, location data, logs and other communication data and the resources that you access and use through the Bellhop Platforms.
  • Information about your computer and internet connection, including your IP address, operating system and browser type.
  • We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).
  • These technologies may also be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or online profiles. The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A “cookie” is a small file placed on the hard drive of your computer by a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Bellhop Platforms.   • Flash Cookies. Certain features of the Bellhop Platforms may use local stored objects (or flash cookies) to collect and store information about your preferences and navigation to, from and on the Bellhop Platforms. Flash cookies are not managed by the same browser settings as are used for browser cookies.   • Web Beacons. Pages of the Bellhop Platforms and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Bellhop to, for example, count users who have visited those pages or opened an e-mail and for other related Service statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Our uses of these technologies fall into the following general categories:

  • Operationally Necessary. This includes technologies that allow you access to our Services, applications, and tools that are required to identify irregular website behavior, prevent fraudulent activity and improve security or that allow you to make use of our functionality;
  • Performance-Related. We may use technologies to assess the performance of our Services, including as part of our analytic practices to help us understand how individuals use our services (see Analytics below);
  • Functionality-Related. We may use technologies that allow us to offer you enhanced functionality when accessing or using our Services. This may include identifying you when you sign into our Services or keeping track of your specified preferences, interests, or past items viewed;
  • Advertising-or Targeting-Related. We may use first party or third-party Technologies to deliver content, including ads relevant to your interests, on our Services or on third-party websites.

3. Third-party Use of Cookies and Other Tracking Technologies.

Bellhop may from time to time contract with third parties to assist us in collecting, maintaining, and managing user information, processing credit card and payment information, and providing analytics regarding your interactions with the Bellhop Platforms and other third-party websites so that we may improve the Bellhop Platforms. Some content or applications, including advertisements, through the Bellhop Platforms are served by third-parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Bellhop Platforms.

The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly, as set forth in the “YOUR CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION” section below.

HOW WE USE YOUR INFORMATION

For our other legitimate interests to make available and highlight content and opportunities that are relevant to you, improve the Bellhop Platforms, maintain our relationship with you, and protect users of the Bellhop Platforms and customers, where your rights and freedoms do not outweigh these interests. We use information that we collect about you or that you provide to us to:

  • Present the Bellhop Platforms and its contents to you;
  • Operate, maintain, and improve the Bellhop Platforms and products, including to develop new products and services;
  • Use your geolocation to provide location-based services, including locating third-party providers of moving and delivery services near you;
  • Provide you with information, estimates, products, or services that you request from Bellhop;
  • Send information including notices about your service requests, confirmations, schedules, invoices, reservation dates, information about our employees or contractors, and support and administrative messages;
  • Notify you about changes to the Bellhop Platforms or any products or services we offer or provide though it;
  • Respond to comments and questions and provide customer service support;
  • Communicate with you about promotions, educational scholarships, our blog, and other news about products or services offered by us;
  • Deliver targeted marketing, service updates, and promotional offers based on your communication preferences, and to measure the performance of our email marketing campaigns;
  • Decide which ads to show you by only showing you those that “match” your past viewing, browsing and shopping activity. Many advertising services collect and use data from your web and mobile app activity both on and off the Bellhop Platforms to help show you ads that are more targeted to your interests;
  • Analyze your use of the Bellhop Platforms, including interactions with applications or services made available, linked to, or offered through the Bellhop Platforms;
  • Carry out our obligations and enforce rights arising from any contracts entered into between you and us, including for billing and collection;
  • Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity; or
  • With your consent, we may use your Personal Information to provide you with marketing via telephone calls, emails, SMS or text, or provide you with marketing from third parties.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Additionally, we may contract with service providers to serve ads on our behalf across the Internet. They collect information about your use of the Bellhop Platforms. They also may use information about your visits to the Bellhop Platforms and other websites to improve the features and functionality we make available through the Bellhop Platforms. In all cases, however, we will only use your information as permitted by applicable law.

The information we collect automatically is statistical data and may include Personal Information, or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve the Bellhop Platforms and to deliver a better and more personalized service, including by enabling us to:

  • Estimate audience size and usage patterns.
  • Store information about your preferences, allowing Bellhop to customize the Bellhop Platforms according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to the Bellhop Platforms.

We use your information for various administrative purposes, such as:

  • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
  • Ensuring internal quality control and safety;
  • Authenticating and verifying individual identities;
  • Debugging to identify and repair errors with our Services;
  • Auditing relating to interactions, transactions and other compliance activities;
  • Enforcing our agreements and policies; and
  • Complying with our legal obligations.

We also use your information for other purposes as requested by you or as permitted by applicable law.

  • Consent. We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent.
  • De-identifiedand Aggregated Information. We may use personal information and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Services, or other analyses we create.
  • Share Content with Friends or Colleagues. Our Services may offer various tools and functionalities. For example, we may allow you to provide information about your friends through our referral services. Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services.

SHARING YOUR INFORMATION

We may share your Personal Information that we collect or you provide as described in this Policy with the following types of recipients:

  • Our subsidiaries and affiliates;

  • Our contractors, service providers and other third parties we use to support our business and the Bellhop Platforms, including:

    • Software and service providers we use to manage and process your information (e.g., payment processing software);
    • Software and service providers we use to communicate with you (e.g., e-mail marketing service providers);
    • Advertising service providers we use to assist us in providing personalized advertising;
    • Service providers we use to store, manage, and maintain the Bellhop Platforms, its content, and the data we process, including any data analytics or information security providers; and
    • Hosting providers that provide database storage for our business.
  • With a buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding;

  • To third parties to market their products or services to you if you have not opted out of these disclosures. We will contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them;

  • To fulfill the purpose for which you provide it. For example, if you give us an e-mail address to use the e-mail a friend feature of the Bellhop Platforms, we may transmit the contents of that e-mail and your e-mail address to the recipients;

  • To comply with any court order, law or legal process, including to respond to any government or regulatory request;

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our business, customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction, in the event of an emergency, and in order to enforce our agreements, policies, and Terms of Use; or

  • With your consent.

We may also share aggregated non-personal information about our users with others without restriction.

OPTING OUT OF INTEREST-BASED ADVERTISING AND TRACKING

  • We have have several ways to opt-out of interest-based advertising: You may choose to allow or disable cookies which are not required for our sites via [DO NOT SELL OR SHARE MY PERSONAL INFORMATION/COOKIE PREFERENCES], which may be accessed through the banner when first visiting our Website.   • In some instances, you can opt-out of receiving interest-based online ads from us, third party advertisers and ad networks. We do not control third parties' collection or use of your information to serve interest- based advertising. Advertisers and ad networks that are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising provide opt-out choices at the following websites:

Be advised that these opt-out tools are provided by third parties and may not be available with respect to all interest-based advertising that is presented to you. We do not control or operate these tools or the choices that advertisers and others provide through these tools. Even if you opt out of receiving interest- based advertising, you may still receive generic ads.

  • You may also opt out of receiving interest-based ads from Amazon, Facebook and Google. You will continue to see ads on each platform, but they will not be personalized as a result of your actions on our website. Please visit the links below if you wish to opt out or update your preferences:

  • The effect of an opt-out will be to stop personalized advertising, but it will still allow the collection of personal information as otherwise described in this Policy.

  • On mobile devices, you can control device-level advertising privacy settings.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (NAI) on the NAIs website.

  • Certain Email and Online Profile Advertising. You may opt out of the tracking technologies that may also be used by our online data partners or vendors to associate your online activities with other personal information they or others have about you, including by association with your email or online profiles. ADDITIONAL OPT-OUT CHOICES

  • Email and Telephone Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding our Services or updates to our Terms or this Privacy Policy). We process requests to be placed on do-not-mail, do-not-phone, and do-not-contact lists as required by applicable law.

  • Text Messages.You may opt out of receiving marketing text messages from us by following the instructions in the text message/replying "STOP" to a text message you have received from us or by otherwise contacting us. To opt-out of transaction-related texts regarding us, and products and Services you have requested (as noted above), please email us at privacy@bellhop.com.
  • Mobile Devices. We may send you push notifications through our mobile application. You may opt out from receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information if you use our mobile application. You may opt out of this collection by changing the settings on your mobile device.
  • “Do Not Track.” Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

ACCESSING AND CORRECTING YOUR INFORMATION

You may send us an e-mail at support@getbellhops.com or support@bellhop.com to request access to, correct or delete any Personal Information that you have provided to Bellhop. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your Personal Information from the Bellhop Platforms, copies of your Personal Information may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Bellhop Platforms. Proper access and use of information provided on the Bellhop Platforms, including Personal Information, is governed by our Terms of Service.

LINKS TO THIRD PARTY WEBSITES AND SERVICES

The Bellhop Platforms may have links to other websites that are not operated by Bellhop. Inclusion of any linked website on the Bellhop Platforms does not imply or express an approval or endorsement of the linked website by Bellhop, or of any of the content, opinions, products, or services provided on these websites. Even if an affiliation exists between the Bellhop Platforms and a third-party web site, we exercise no control over linked sites. We have no control over how these websites may collect your information and no liability for the practices, policies and security measures implemented on these websites. You should read the privacy policies on those other websites before you submit your information through them.

OUR COMMITMENT TO CHILDREN’S PRIVACY

Protecting the privacy of children is important to Bellhop, and the Bellhop Platforms are not intended for children under 13 years of age. The Children’s Online Privacy and Protection Act of 1998 (“COPPA”) defines a “Child” as anyone under the age of thirteen (13) years old. We strictly adhere to COPPA, and we do not collect Personal Information from those we actually know are under 13. If you are under 13, do not use or provide any information through the Bellhop Platforms or on or through any of its features, register through the Bellhop Platforms, make any purchases through the Bellhop Platforms, use any of the interactive or public comment features of the Bellhop Platforms, or provide any information about yourself to Bellhop. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. DATA SECURITY

Security of information communicated by or to us over the Internet is of utmost concern to us; unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through the Bellhop Platforms. Please note that email, like most non-encrypted Internet communications, may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to us. For that reason, to protect your privacy, please do not use email or submit through the Bellhop Platforms any information that you consider confidential. While we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or through the Bellhop Platforms, and you do so at your own risk.

We urge you to be careful about giving out information in public areas of the Bellhop Platforms like message boards. The information you share in public areas may be viewed by any user of the Bellhop Platforms.

RETENTION PRACTICES

We store personal information for as long as reasonably necessary to carry out the purposes for which we originally collected it, and for other legitimate business purposes, including meeting our legal, regulatory, and other compliance obligations.

SPECIAL NOTICE TO NON-UNITED STATES USERS

If you are located outside the United States of America and are using the Bellhop Platforms, you should be aware that your Personal Information will be transferred to the United States of America, the laws of which may be deemed by your country to have inadequate data protection. If you are located in a country outside the United States of America and voluntarily submit personal information to Bellhop, you thereby consent to the general use and onward disclosure of such information as provided in this Policy and to the transfer of that information to and storage of that information in the United States of America.

CHANGES TO THIS POLICY

We may revise and update this Policy from time to time. When we make a material change that affects your privacy rights, we will provide appropriate notice to you by email, by posting the updated Policy on our Website or App, or by any other reasonable means. You will be deemed to have accepted any updates or modifications to this Policy by, among other things, continuing to access or use the Services. We encourage you to check this page frequently to review the Policy currently in effect and any changes that may have been made. PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice for California Residents applies solely to the personal information of individuals who reside in the State of California who are users of the Bellhop Platforms, including Movers (“Covered Individuals”). We have provided this Privacy Notice for California Residents (“CCPA Notice”) to comply with the California Consumer Privacy Act of 2018 (the “CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice. It explains what personal information we collect, where we collect it from, what we use it for, who we disclose it to, how long we keep it, the rights California residents may have, and how to exercise them. This CCPA notice does not apply to Bellhop employees personnel or job applicants, or individuals who do not reside in California.

To the extent we process de-identified information, we will maintain and use the information in de-identified form and will not attempt to re-identify the information unless permitted by applicable law.

Categories of Personal Information We May Collect

Depending on the nature of your relationship with us, we may collect (and may have collected during the 12-month period prior to the last updated date of this CCPA Notice):

  • Identifiers: such as name, address, unique personal identifier, IP address, email address, Social Security number, driver’s license, passport number, date of birth and other similar identifiers;
  • Personal information Listed in the California Customer Records Statute (Cal. Civ. Code Sec. 1798.80(e): such as contact information and financial information.
  • Characteristics of protected classifications, such as sex/gender and marital status, race, national origin, military, and veteran status
  • Commercial information, such as transaction and account information
  • Biometric information, such as voice recordings and voiceprint
  • Internet or network activity information, such as browsing history and interactions with our website(s)
  • Geolocation data, such as device location
  • Audio, electronic, visual or similar information, such as call and video recordings
  • Inferences drawn from any of the personal information previously mentioned to create a profile about something such as an individual’s preferences and characteristics.
  • Sensitive Personal Information: Personal information that reveals a Covered Individual’s account log-in, financial account, debit card, or credit card number in connection with any required security or access code, Social Security number, driver’s license, state ID card.

We only collect and process personal information that is considered to be Sensitive Personal Information under the CCPA for the purposes set forth in HOW WE USE YOUR INFORMATION. We do not collect or process Sensitive Personal Information with the purpose of inferring characteristics about Covered Individuals.

Prior Collection, Use and Sharing of Information. The chart below summarizes the categories of personal information we may have collected in the past 12 months, and our business purposes for collecting the information.

For purposes of this disclosure, “share” means sharing a consumer’s personal information with a third party for cross-contextual behavioral advertising for monetary or other valuable consideration or for the benefit of a business in which no money is exchanged.

In the past 12 months, based upon our actual knowledge, we have not “sold” Personal Information or Sensitive Personal Information relating to California residents (including minors under 16 years of age). For purposes of this disclosure, “sold” means the disclosure of Personal Information to a business or third party for monetary or other valuable consideration. We will promptly verify your request and respond within the applicable time frame of forty-five (45) days. Where a request is particularly complex, additional time may be required, we will notify you directly. You may also opt-out from the “sale” or “sharing” of your personal information by e-mailing privacy@bellhop.com

If we are unable to verify your identity as required by the CCPA, we reserve the right to not process your request. Upon this determination, we will notify you of the decision, along with any rights you may have to appeal the decision. Under the CCPA, we are only required to respond to certain rights requests twice in any twelve (12) month period. You may designate an authorized agent to make requests on your behalf. You will need to provide your identification, the identification of the agent, and your written consent for them to act on your behalf.

If you are under 18 years of age, reside in California, and have provided your personal information to our Website, you have the right to request removal of unwanted data that you publicly post on the Website. To request removal of such data, please contact us at privacy@bellhop.com and include sufficient detail about the public post(s) and a statement that you reside in California. If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. You can exercise this right by contacting us at privacy@bellhop.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A.
